 LEAD PAINT REGULATORY ALERT!

Beginning April 22, 2010, any contractor or subcontractor (electricians, plumbers, painters, window replacement, remodelers, etc.) who disturbs paint in a pre-1978 residential home or child-occupied building must comply with the EPA’s Renovation, Repair, and Paint Rule. We strongly encourage you to learn more about the RRP Rule and how you will be affected. More information is available on these websites:

April 14, 2010 UPDATE: The opt-out provision will remain in place for 60 days following the April 22, 2010 implementation date. Under federal law, the Administrative Procedures Act (APA), federal agencies cannot immediately enforce any rule change without giving the public an opportunity to comply or challenge the rule change. So, the EPA will permit use of the opt-out provision for those homes not having children under six-years-old or pregnant woman living in them for another 60 days beginning on April 22.

There is a two-part certification process that all affected firms must abide by:

1.    Complete the
Firm Certification form and send it to EPA with the $300 fee (valid for five years). Do this NOW and keep a copy for your files – you're not likely to get the actual certification from EPA for 6 weeks to 3 months.

2. Get trained as a Certified Renovator – upcoming classes being offered through local builders associations: September 29 in Dickinson, December 3 in Minot and December 8 in Bismarck with other dates likely to be added. Here is the phone number for the local association with upcoming training:

            Minot Associaiton of Builders            701-852-0496
